Terry Lee Smith, 48, of Hancock, is still waiting for a trial after being arrested and charged with several counts of visual surveillance – private area, several counts of Peeping Tom, several counts of private place – prurient intent, and numerous counts of possession of child pornography. In all, Smith was charged with 28 total criminal counts.
Initially, Smith faced an October 17 date in District Court, but the case has been moved to Circuit Court and a trial date of January 6, 2025, has been set with Judge Kirk Downey presiding.
Smith was arrested after police were notified of a Peeping Tom incident involving a juvenile at the Hagerstown Target on June 5.
Police said at the time the juvenile female had been trying on clothes at Target when she observed a black cell phone being held under the door of the changing room by an unknown white male.
Smith was later identified as the suspect and a search and seizure warrant was executed at his Hancock residence where he was found to be in possession of electronic devices containing child pornography.
An arrest warrant was issued on August 17 and served on August 20.
Winfield sentenced
In other court updates, a Berkeley Springs man has pled guilty in a Washington County court to sexual solicitation of a minor.
According to online court records, on November 12, Judge Joseph Michael of the Washington County Circuit Court accepted the plea from Jeremy Eric Winfield, Jr., 30, and sentenced him to 10 years in prison, with all but 18 months of prison time suspended.
Winfield will also serve three years under supervised probation and must register as a Tier II Sex Offender.
He was charged with one count sexual solicitation of a minor, a felony.
Winfield was one of three men arrested in June of this year and charged with solicitation of a minor in a Washington County sting.
